Welcome to Cre8tive Craft & Company. These Terms & Conditions apply to purchases and custom-project orders placed through www.cre8tivecraftco.com or directly with Cre8tive Craft & Company (“we,” “us,” or “our”).
Please read these terms before placing an order. By submitting an order, you agree to these Terms & Conditions, subject to applicable law.
1. Custom Orders and Customer Responsibilities
Our custom products are created according to the details, personalization, photographs, artwork, and other instructions provided for each order.
Customers are responsible for reviewing all submitted information, including names, spelling, dates, sizes, colors, quantities, photographs, and design instructions, before placing an order.
If we provide a design proof for approval, customers are responsible for carefully reviewing it before approving production. Changes requested after approval or after production begins may not be possible and may result in additional charges.
Customer-submitted errors or details approved in a design proof are not considered defects caused by Cre8tive Craft & Company. This does not limit our responsibility for producing an item that differs from the agreed order.
2. All Sales Final—No Returns or Exchanges
Because our custom items are made specifically for each order, all custom-order sales are final. We do not accept returns or exchanges because of a change of mind, personal preference, or customer-submitted errors.
This policy does not limit any rights or remedies that cannot be excluded under applicable consumer protection or warranty laws.
If your item arrives with a defect, please follow the process below.
3. Defective Items and Order Concerns
If your item arrives with a defect or an error attributable to Cre8tive Craft & Company, please contact us promptly using the contact information below.
To help us evaluate your concern, please provide:
- Your name and order number or proof of purchase.
- A description of the defect or issue.
- Clear photographs showing the item and the reported problem.
- Photographs of the packaging if shipping damage is involved.
Each claim will be reviewed individually. Depending on the circumstances, we may offer store credit or a replacement. Neither store credit nor a replacement is automatically guaranteed; decisions are made on a case-by-case basis, subject to applicable law.
Please do not return an item unless we provide instructions authorizing you to do so.
Damage caused after delivery by misuse, improper care, unauthorized alterations, or normal wear is not treated as an arrival defect under this policy.
Nothing in this section limits any remedy that we are required to provide by law.
4. Copyright and Intellectual Property Policy
Cre8tive Craft & Company maintains a strict policy against unauthorized use of copyrighted or otherwise protected material.
We will not reproduce or incorporate third-party copyrighted material into a custom project unless you provide a written copyright release or license from the copyright owner or authorized representative that permits the requested use. This requirement does not apply to original material you created and own or material verified to be in the public domain.
Any permission provided must cover the specific use requested, including reproduction on physical products where applicable. Purchasing an image, finding it online, or possessing a copy does not, by itself, establish permission to reproduce it.
We may request documentation, verify permissions, or decline any project when ownership or authorization is unclear. Trademarked logos and other protected branding also require appropriate authorization.
By submitting material, you confirm that you own it or have the necessary permission to authorize its use for your order.
5. Photographs and Watermarked Images
Photo projects require an original, unwatermarked photograph or an authorized, unwatermarked digital file supplied by the photographer or rights holder.
We will not use photographs containing watermarks, photographer proofs, copyright marks, stock-image overlays, or similar ownership or proof markings under any circumstances. We will not remove, crop out, obscure, or edit around these markings to make an image usable.
A copyright release does not override this file requirement. If a photographer or other rights holder has authorized reproduction, you must still provide an unwatermarked file along with any required written release.
Providing an unwatermarked photograph does not, by itself, establish ownership or reproduction rights. Customers must also have permission for the requested use.
We may pause or decline a photo project until acceptable files and any necessary permissions are provided.
6. Ownership of Designs and Custom Project Work
Cre8tive Craft & Company retains all intellectual property rights it owns in the original designs, artwork, layouts, templates, and other creative elements it develops for a project, to the extent protected by law.
Payment for a custom order purchases the finished product and its permitted use. It does not transfer copyright ownership, reproduction rights, editable design files, templates, or other intellectual property rights belonging to Cre8tive Craft & Company.
Customers may not reproduce, distribute, license, or commercially exploit our original designs or use them to manufacture additional products without our prior written permission.
Customer-provided photographs, artwork, logos, and other materials remain the property of their respective rights holders. By submitting those materials, you grant us a limited, nonexclusive license to use, reproduce, and adapt them as reasonably necessary to prepare and fulfill your order. Submitting material does not transfer its ownership to us or authorize unrelated advertising use.
7. No Resale or Commercial Reproduction
Products ordered from Cre8tive Craft & Company are sold for personal use or gifting only, not for resale.
As a condition of purchase, you agree not to purchase or use our products for resale, redistribution for payment, wholesale distribution, or incorporation into merchandise offered for sale.
You may not copy, scan, digitize, or otherwise reproduce our original designs to make products for sale or supply those designs to another manufacturer for commercial production.
We do not offer resale rights with any purchase. These restrictions apply to the fullest extent permitted by applicable law and do not claim rights that the law does not allow us to restrict.
8. Order Acceptance and Requests We Cannot Fulfill
All custom orders are subject to review and acceptance.
We may decline a project that does not meet our copyright, image-quality, authorization, or other requirements described in these terms.
If an order cannot proceed, we will communicate its status and address any payment already collected according to the circumstances and applicable law. These terms do not authorize us to retain payment for work we have not performed without a lawful basis.
9. Changes to These Terms
We may update these Terms & Conditions from time to time. The current version will be posted on our website with its effective date.
Unless otherwise agreed or required by law, the terms in effect when an order is placed will apply to that order.
